Springova Terms of Use

This documents sets out the Terms of use of the Springova site, and details the responsibilities of Springova, CDG Telco Ltd. and you, the Springova members. Your use of the Springova site implies your acceptance of these Terms and of the Springova Privacy Policy so please find the time to read both documents thoroughly and let us know of any queries you may have.

The content of these Terms and the Privacy Policy may be amended from time to time. It is your responsibility to keep up to date with any amendments that are relevant to your use of the Springova site.

These Terms and the Privacy Policy form the basis of an agreement between you, the Springova member, and CDG Telco Ltd., the company responsible for operating the Springova site and maintaining the proper use and security of personal details and content uploaded onto Springova.

The Springova Team, on behalf of CDG Telco Ltd., will endeavour to uphold and enforce all parts of these Terms, however, should a part of these Terms not be enforced, this should not be considered a waiver of that part or any other part of these Terms, and your acceptance of these Terms will continue to be assumed by your continued use of the Springova site. The Springova site, and CDG Telco Ltd. are, and will continue to be, governed by the laws of England and Wales. There is nothing in these Terms that violates those laws.

Your Privacy

The Springova Privacy Policy describes in more detail how Springova members are allowed to use the Springova site, and how Springova and CDG Telco Ltd. can use your personal details and any content you post/upload to the site. Please take the time to read our Privacy Policy as your use of the Springova site implies your acceptance of the Privacy Policy as well as these Terms.

 

Your Content and Personal Details

  • You, the Springova member, own all of the content you post or upload onto Springova

  • You can control how your content and personal information is shared with other Springova members through your profile settings and your account privacy settings

  • If you post or upload content that is covered by Intellectual Property Rights (e.g. photos), you specifically give us permission, subject to your account privacy settings, to use any content that you post on Springova, until you delete that content. We can still continue to use your content if it has been shared with other Springova members and they have not deleted the content

  • When you delete content you have posted on Springova, you accept that that content may persist in backup copies of the Springova site for a period of time, but will not be available to other Springova members

  • When you publish content or personal details using the “Public” profile/account settings, you understand that you allow everyone, including non-Springova members to access and use that information

  • If you pass on feedback or suggestions for Springova to us, you understand that we are free to use this content however we choose

 

Your Safety

The Springova Team, on behalf of CDG Telco Ltd., will endeavour to keep Springova safe for all Springova members, but by using the Springova site, you accept that we cannot guarantee that safety. By registering as a Springova member, you agree to the following conditions to assist us in keeping the site as safe as possible for all Springova members:

  • You will not collect members’ personal details from the Springova site either manually or through the use of automated means (e.g. spambots) without the written permission of the Springova team

  • You will not instigate or take part in any illegal marketing schemes or commercial activity on the Springova site

  • You will not upload viruses to the Springova site or carry out any other malicious activity with the intent to damage the functionality or content of the Springova site

  • You will not do anything that could disable or impair the proper working of the Springova site

  • You will not solicit login information from any other Springova member or access another Springova member’s account

  • You will not bully, harass or intimidate any other Springova member

  • You will not post/upload content to the Springova site that is hateful, threatening, pornographic, or could in any other way be considered offensive or abusive by other Springova members

  • You will not post/upload content to the Springova site containing graphic or gratuitous nudity or violence, or content that is intended to incite violent or threatening behavior from other Springova members

  • You will not use the Springova site with the intent to do anything illegal, malicious or discriminatory, concerning Springova members or non-Springova members

  • You will not facilitate or encourage any violations of either these Terms or of the Springova Privacy Policy

 

Your Account Security

The Springova Team, on behalf of CDG Telco Ltd., will endeavour to keep your Springova account secure, but by using the Springova site, you accept that we cannot guarantee that security. By registering as a Springova member, you agree to the following conditions to assist us in keeping the site as secure as possible for all Springova members :

  • You will not enter any false personal details onto the Springova site

  • You will not create a Springova account for any other person, company or institution, without express written permission from the Springova Team

  • You will not create more than one student, agent or institution profile without express written permission from the Springova Team

  • If your account is deleted from the Springova site, or you are banned from the Springova site, you will not create a new account without express written permission from the Springova Team

  • You will not use Springova if you are under 14 years of age

  • You will not use Springova if are a convicted sex offender

  • You will keep the personal details you choose to enter on the Springova site as up to date as possible

  • You will not share your username or password with anyone else, allow anyone else to access your Springova account, or do anything else that might endanger the security of your Springova account

 

 

Your responsibility to protect your rights and the rights of other Springova members

We expect all Springova members to respect the rights of other users of the Springova site, and your use of the Springova site implies your agreement to follow the following commitments:

  • You will not post/upload content of any kind, or carry out any activity on the Springova site that is in violation of the rights of any other Springova user

  • You will not post/upload any content of any kind, or carry out any activity on the Springova site that is in violation of the laws of England and Wales

  • The Springova Team reserve the right to remove any content of any kind that is uploaded to the Springova site, if we believe that content to be in violation of these Terms, the Springova Privacy Policy, or the laws of England and Wales

  • If you believe that another Springova member has violated your Intellectual Property Rights, you have the right to report this to the Springova Team, who will investigate the matter on behalf of CDG Telco Ltd. and act appropriately

  • If we remove your content after a claim that you have violated the Intellectual Property Rights of another Springova member, you have the right to appeal the removal in writing to the Springova Team, who will investigate the matter on behalf of CDG Telco Ltd. and act appropriately

  • If you are repeatedly reported for violating the Intellectual Property Rights of other Springova members, the Springova Team reserves the right to delete your account and/or ban you from the Springova site as appropriate

  • If you collect personal details or information from other Springova members for your own commercial benefit (for example if you are a registered agent or academic institution), it is your responsibility to obtain the consent of the members in question before using their personal details in any way. It is also your responsibility to make it clear to the members in question how you intend to use those details

  • You will be considerate towards other Springova members at all times, and you will never post personal details or sensitive personal or financial information about another Springova member

  • You will only post/upload content, photos etc. relating to another Springova member with their prior consent to do so

  • You will only invite non-Springova members to join Springova with their prior consent ―please refer to the specific ‘Win an iPad Competition’ Terms and Conditions and ‘Refer a Friend Scheme’ Privacy Policy for more details

 

Springova Mobile Website and Smartphone Apps

  • The Springova mobile website and Smartphone Apps are provided free by CDG Telco Ltd., but your mobile network’s usual rates will apply, e.g. mobile internet browsing charges, sms charges etc

  • CDG Telco Ltd. may, at any time, make the decision to charge a fee for the download of the Springova Smartphone Apps

  • It is your responsibility to update the mobile phone number attached to your Springova account. If you change your phone number, the Springova Team or CDG Telco Ltd. will not be held accountable for any claims arising from sms updates and notifications sent to the wrong phone number if you have failed to update your details

  • You understand that any personal information you make visible on the Springova site may be transferred to members’ mobile devices through the synchronisation of Springova contacts with contacts saved on members’ mobile devices

 

Amendments to these Terms

  • The Springova Team, on behalf of CDG Telco Ltd. reserves the right to amend these Terms or the Springova Privacy Policy for any reason, at any time. Please check this page regularly for updates

  • We will endeavour to give notice of any change to these Terms via a message and email to all our members. However we can make changes to these Terms or Privacy Policy for any reason without giving prior notice to Springova members

 

Deletion of your Springova Account

  • If the Springova Team determines that you have violated these Terms or the Privacy Policy, or have put Springova, CDG Telco Ltd., or any other Springova member at risk, it has the right to delete your Springova account and/or ban you from the Springova site at any time

  • You can delete your own student, agent or institution account at any time

  • Once you are no longer a Springova member, your connection with Springova or CDG Telco Ltd. will cease, and these Terms and the Springova Privacy Policy will no longer apply to you. However, you will still be bound by the laws of England and Wales regarding privacy and Intellectual Property Rights, and you must still respect the privacy and Intellectual Property Rights of Springova members whose personal details and content you possess after your Springova account has been deleted

Claims and Disputes

  • You will resolve any claim or dispute you have with Springova or CDG Telco Ltd. arising from the Springova site in the courts of England and Wales. The laws of England and Wales govern these Terms, our Privacy Policy, and any claim arising between Springova or CDG Telco Ltd. and any Springova member. You agree to respect the decision of the courts located in England and Wales in any claim or dispute arising between you and Springova or CDG Telco Ltd.

  • You commit to indemnify Springova and CDG Telco Ltd. from any damages, losses, expenses and legal fees related to any claim bought against Springova or CDG Telco Ltd. because of your activity on the Springova site, or content or details posted by you on the Springova site

  • You choose to use Springova at your own risk, and neither the Springova team, nor CDG Telco Ltd. make any guarantees of the safety or security of using the Springova site, or of the accuracy of any information on the Springova site

  • Neither Springova nor CDG Telco Ltd. can be held responsible for the activity of Springova members or of any third parties on the Springova site, or for any content or details posted on the Springova site by Springova members or any third parties. Your use of the Springova site implies your agreement to release Springova, CDG Telco Ltd., and the directors, employees and agents of both companies from any damages, losses, expenses and legal fees arising from any claim or dispute between you and any other Springova member or any third party connected with the Springova site

Data Processing and users outside of England and Wales

By nature, Springova is a global social network, and your use of the Springova site implies your acceptance of these Terms and our Privacy Policy, and your agreement to abide by the laws of England and Wales, as well as the laws of your country, while using the Springova site ― regardless of the country in which you are resident. Your use of the Springova site also implies your consent to your personal details and content you upload to the site being transferred to and processed in England and Wales and/or in other country in which CDG Telco Ltd. or its partner company, SpringBoard4Asia, have operating offices.
